Item 7.01 Regulation FD Disclosure.
As previously disclosed, the Company and certain of its affiliates are named as defendants in a lawsuit first filed in December 2006 in connection with the termination of leases at our former Houston Town & Country hospital and medical office building. Jury trial for that case, Miguel Franco, M.D., et al v. Memorial Hermann Healthcare System, et al, had been set for September 2009 in Harris County, Texas District Court. For reasons unrelated to the Company or its affiliates, the trial date has now been reset for January 2010.
The information in Item 7.01 shall not be deemed “filed” for purposes of Section 18 of the Securities Exchange Act of 1934, as amended, nor shall it be deemed incorporated by reference in any filing under the Securities Act of 1933, as amended, except as expressly set forth by specific reference in such filing.
