On January 5, 2007, Brooks Automation, Inc. (“Brooks”) issued a press release announcing that it had received a request for additional information (commonly referred to as a “Second Request”) from the Antitrust Division of the U.S. Department of Justice regarding its proposed sale of Brooks Software, a division of Brooks, to Applied Materials, Inc., a copy of which is attached hereto as Exhibit 99.1 and which is incorporated herein by reference.
